TERMS OF USE AND SERVICE CONDITIONS

1. IDENTIFICATION AND SERVICE OWNERSHIP

In compliance with Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), the following information is provided:

Adabida is a digital historical archive dedicated to the preservation of oral memory and personal heritage, with an academic vocation and historiographical rigor.

2. PURPOSE AND SCOPE OF APPLICATION

2.1. PURPOSE

These Terms of Use regulate access to and use of the Adabida service (hereinafter, the "Service" or the "Platform"), accessible through the website www.adabida.cat and its associated applications.

2.2. SCOPE OF APPLICATION

These terms apply to all users of the Service, whether registered or unregistered visitors. Use of the Service implies full and unreserved acceptance of all clauses included in this document.

2.3. MODIFICATIONS

Adabida reserves the right to modify these Terms of Use at any time. Modifications shall enter into force upon publication on the website. Users will be notified of substantial changes by email with a minimum of 30 days' notice. Continued use of the Service after publication of the modifications implies acceptance of the new terms.

3. DEFINITIONS

For the purposes of these Terms of Use, the following definitions apply:

  • USER: Any person who accesses and uses the Service.
  • REGISTERED USER: A person who has completed the registration process and has an active account on the Platform.
  • ENTRY / TESTIMONY: Oral memory content (text, audio, video, images) published by a user in the public Adabida archive.
  • PERSONAL PROFILE: An individual user space containing biographical and genealogical data.
  • FAMILY SPACE: A collaborative area for managing the memory of a family or genealogical line.
  • ORGANIZATION: A space for clubs, associations or entities wishing to preserve their collective memory.
  • DOCUMENT: A digital file (image, PDF, etc.) uploaded by the user to the Platform.
  • VERIFICATION SYSTEM: An identification mechanism based on documentation provided by the user.

4. ACCESS TO THE SERVICE AND USER REGISTRATION

4.1. ACCESS CONDITIONS

Access to the Service is free and universal. However, certain features require prior registration.

4.2. MINIMUM AGE

To register as a user on Adabida, you must be at least 18 years old. By registering, the user declares and guarantees that they are of legal age.

4.3. REGISTRATION PROCESS

Registration requires:

  • First and last name
  • A valid email address
  • A secure password
  • Acceptance of these Terms of Use
  • Acceptance of the Privacy Policy

4.4. ACCURACY OF INFORMATION

The user guarantees that all data provided during registration is truthful, accurate, complete and up to date. The user is responsible for keeping this information updated.

4.5. CONFIDENTIALITY OF CREDENTIALS

The user is responsible for maintaining the confidentiality of their password and access credentials. Any activity carried out from their account shall be presumed to have been carried out by the user.

4.6. SUSPENSION AND TERMINATION OF ACCOUNTS

Adabida reserves the right to suspend or terminate accounts that:

  • Violate these Terms of Use
  • Publish illegal or inappropriate content
  • Use the Service fraudulently
  • Infringe upon the dignity or rights of third parties

5. NATURE OF THE SERVICE: ORAL MEMORY ARCHIVE

5.1. ACADEMIC NATURE

Adabida is conceived as a project with an academic vocation and historiographical rigor, aimed at creating a documentary oral memory archive accessible to researchers and to anyone wishing to preserve their legacy or that of their family.

5.2. UNVERIFIED TESTIMONIES

⚠️ IMPORTANT WARNING: The testimonies and content stored on Adabida are authentic personal memories, but they are NOT verified by professional historians.

Adabida preserves memory as people remember and share it. This means that:

  • Testimonies reflect personal perceptions and memories
  • There may be errors in dates, names or events
  • Human memory is subjective and may change over time
  • Adabida does not verify facts or cross-check sources

5.3. PRIMARY SOURCES, NOT ABSOLUTE TRUTHS

Adabida content must be treated as PRIMARY SOURCES for historical research, not as verified historical truths. Any researcher, historian or journalist using these materials must:

  • Cross-check the information with other primary and secondary sources
  • Apply critical methodology
  • Not consider testimonies valid without independent verification
  • Properly cite the source and context

5.4. HISTORICAL AND HUMAN VALUE

Despite the limitations described above, personal testimonies have immense historical and human value. They offer personal perspectives on historical events, emotional and human context, details of everyday life, and voices often excluded from official history.

6. IDENTITY VERIFICATION SYSTEM

6.1. NATURE OF THE SYSTEM

Adabida provides an identity verification system based on documentation supplied by users themselves (ID card, passport, birth certificates, etc.).

6.2. VISUAL INDICATOR

Profiles with verified documentation are marked with a visual indicator (e.g. green badge), but this ONLY indicates that the user has submitted documents.

6.3. SYSTEM LIMITATIONS

⚠️ IMPORTANT: Under no circumstances can Adabida validate the authenticity of such documentation. The verification system:

  • Is purely indicative within the project
  • Has no scientific validity
  • Has no legal validity
  • Does not guarantee the real identity of the user
  • Does not guarantee the authenticity of the submitted documents

6.4. USER RESPONSIBILITY

Any user who submits false or forged documentation commits an offence and assumes full legal responsibility arising therefrom.

7. USER-GENERATED CONTENT

7.1. CONTENT GENERATION CHANNELS

The content of the Adabida archive is generated by users themselves through three main channels:

  • INDIVIDUAL PROFILES: Personal space with biography, genealogical data and personal documents
  • FAMILY SPACES: Collaborative areas for families
  • ORGANIZATIONS: Spaces for clubs, associations and entities

7.2. TYPES OF CONTENT

Users may publish:

  • Text entries (memories, testimonies, biographies)
  • Audio (voice recordings, interviews)
  • Video (video testimonies)
  • Photographs and images
  • Digital documents (PDFs, document images)

7.3. CONTENT VISIBILITY

7.3.1. ENTRIES AND TESTIMONIES – ALWAYS PUBLIC

⚠️ IMPORTANT: All entries and testimonies published on Adabida are PUBLIC and UNIVERSAL in nature. They appear associated with the name of the user who publishes them.

If a user does not want information to be public, they must NOT publish it.

Entries are indexable by search engines and accessible to anyone on the internet.

7.3.2. PROFILES, FAMILY SPACES AND ORGANIZATIONS – CONFIGURABLE

Users may configure the visibility of these spaces as:

  • Public (accessible to everyone)
  • Private (only authorized members)
  • Mixed (some public sections, others private)

7.4. INTELLECTUAL PROPERTY OF CONTENT

7.4.1. USER OWNERSHIP

✓ Content published by users is and will always remain their property. Adabida acts solely as custodian and dissemination platform.

7.4.2. LICENSE GRANTED TO ADABIDA

By publishing content, the user grants Adabida a license that is:

  • Non-exclusive (the user may publish the same content elsewhere)
  • Worldwide
  • Free of charge
  • Transferable
  • Sublicensable

To store, reproduce and distribute the content, display it publicly through the Platform, create backup copies and optimize it technically.

7.4.3. LICENSE GRANTED TO THIRD PARTIES

Public Adabida content may be used by third parties (researchers, journalists, students) under the following conditions:

  • Mandatory citation of the source (user name and "Adabida - Oral Memory Archive")
  • Respectful and dignified use of the content
  • No substantial alteration of the content without indication
  • Compliance with applicable intellectual property laws

8. LIABILITY FOR CONTENT

8.1. USER LIABILITY

The user is the SOLE RESPONSIBLE PARTY for the content they publish on Adabida. By publishing content, the user guarantees that:

  • They own the intellectual property rights or have the necessary authorizations
  • The content does not violate third-party rights (honor, privacy, image, intellectual property)
  • The content is truthful to the best of their knowledge

The content must NOT contain:

  • Defamatory or slanderous information
  • Content inciting hatred, violence or discrimination
  • Pornographic or sexually explicit content
  • Personal data of third parties without their consent
  • Information violating professional or state secrets
  • Threats, harassment or intimidation
  • False information intended to harm third parties

8.2. DISCLAIMER OF ADABIDA LIABILITY

Adabida acts as a hosting platform for user-generated content. Pursuant to Article 16 of the LSSI-CE, Adabida is NOT responsible for stored content provided it has no actual knowledge of its unlawfulness and, upon acquiring such knowledge, acts diligently to remove it.

8.3. ILLEGAL CONTENT NOTICE SYSTEM

Any person who believes there is illegal content on the Platform may notify it via: admin@adabida.cat

The notification must include:

  • Identification of the illegal content (exact URL)
  • Reasons why it is considered illegal
  • Contact details of the notifier
  • Good faith declaration

Adabida will review the notification and, where appropriate, remove the content within a maximum of 48 hours from receipt.

8.4. ADABIDA RESERVATIONS

Adabida reserves the right to:

  • Remove content that violates these Terms of Use without prior notice
  • Suspend or terminate accounts that repeatedly publish inappropriate content
  • Communicate content relevant to historical research to the scientific community
  • Cooperate with judicial and law enforcement authorities when legally required

9. PERSONAL DATA PROCESSING

For complete information on the processing of personal data, please consult our Privacy Policy.

Summary:

  • Purpose: Account management and provision of the archive service
  • Legal basis: Contract performance and consent
  • Rights: Access, rectification, erasure, portability, objection

10. RIGHT TO ERASURE AND DATA PORTABILITY

10.1. DIGITAL RIGHT TO BE FORGOTTEN

At any time, the user may request the complete deletion of their account and all their data. This is a fundamental right that Adabida fully respects.

10.2. PROCEDURE

  1. Send a request to admin@adabida.cat
  2. Confirm identity (for security reasons)
  3. 30-day reflection period (the user may cancel the deletion)
  4. After 30 days, definitive deletion of personal data, private documents and settings

10.3. PUBLIC CONTENT

OPTION A: The user may request that public content (entries, testimonies) also be deleted.

OPTION B: The user may request that public content remain in the archive (due to its historical value), but with personal data anonymized.

10.4. DATA PORTABILITY

The user may request a copy of all their data in downloadable format (ZIP with PDFs, images, videos, etc.) at: admin@adabida.cat

Delivery timeframe: 30 days

11. SECURITY AND PRIVACY

11.1. SECURITY MEASURES

Adabida applies appropriate technical and organizational measures to protect personal data against unauthorized access, accidental loss or unlawful destruction.

11.2. BACKUPS

Periodic backups of content are performed to prevent data loss.

11.3. USER RECOMMENDATIONS

⚠️ Users are advised to:

  • Maintain personal backups of important content
  • Not use Adabida as the sole repository for irreplaceable documents
  • Periodically review stored content

12. INTELLECTUAL PROPERTY OF THE PLATFORM

12.1. OWNERSHIP

All elements of the Adabida Platform (design, code, logos, brand, structure, etc.) are the property of Ilan Sánchez or are used under the appropriate licenses.

12.2. PROHIBITIONS

The following is prohibited:

  • Reproducing, copying or distributing Platform elements without authorization
  • Modifying, decompiling or reverse engineering the code
  • Using the "Adabida" trademark without express permission

13. FREE TECHNOLOGIES AND INDEPENDENCE

COMMITMENT TO FREE SOFTWARE

Adabida uses open-source and free software technologies whenever possible, in line with its ethical principles of transparency and technological sovereignty.

INDEPENDENT SERVERS

Adabida does not depend on major technology corporations. It uses independent servers to ensure privacy and real control over data.

14. FUNDING MODEL

14.1. FREE SERVICE

✓ Adabida is and will always remain 100% free for users. No one should be excluded for economic reasons.

14.2. FUNDING

The service is funded exclusively through voluntary community contributions.

14.3. PUBLIC COMMITMENTS

Adabida publicly commits to:

  • Never charging for access
  • Never selling user data
  • Never including advertising
  • Publishing an annual financial report
  • Maintaining free technologies

15. SERVICE LIMITATIONS – DEMO PHASE

15.1. CURRENT STATUS

⚠️ Adabida is currently in DEMO PHASE (development). This means that:

  • Permanent 24/7 service availability cannot be guaranteed
  • Temporary interruptions may occur for maintenance or improvements
  • Some features may change or evolve
  • The technical architecture may be modified

15.2. NO GUARANTEE OF ETERNAL CONTINUITY

Adabida cannot guarantee its indefinite existence over time. Although the commitment is to maintain the service as long as possible, external factors (technical, economic, legal) may force service interruption.

16. DISCLAIMER OF WARRANTIES AND LIABILITY

16.1. SERVICE PROVIDED “AS IS”

The Service is provided “as is”, without warranties of any kind, express or implied.

16.2. NO WARRANTIES

Adabida does not guarantee:

  • Permanent availability and continuity of the Service
  • Error-free or uninterrupted operation
  • The suitability of the Service for specific purposes
  • The truthfulness, accuracy or timeliness of user-generated content

16.3. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Adabida shall not be liable for:

  • Direct or indirect damages arising from use of the Service
  • Loss of data, profits or opportunities
  • User-published content
  • Temporary service interruptions
  • Errors or malfunctions

17. THIRD-PARTY LINKS

The Platform may contain links to third-party websites. Adabida is not responsible for the content, privacy policies or practices of such third-party websites. Users access them at their own risk.

18. DURATION AND TERMINATION

18.1. DURATION

These Terms of Use have indefinite duration and remain in force as long as the user accesses or uses the Service.

18.2. TERMINATION BY THE USER

The user may cease use of the Service and delete their account at any time by exercising the right to be forgotten.

18.3. TERMINATION BY ADABIDA

Adabida may suspend or terminate a user account if the user seriously or repeatedly violates these Terms of Use, uses the Service fraudulently or publishes content that infringes third-party rights.

19. APPLICABLE LAW AND JURISDICTION

19.1. APPLICABLE LAW

These Terms of Use are governed by and interpreted in accordance with Spanish law.

19.2. JURISDICTION

For the resolution of any dispute arising in connection with these Terms of Use, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Barcelona, expressly waiving any other jurisdiction that may apply.

19.3. INTERNATIONAL USERS

Users residing outside Spain expressly agree to submit to Spanish law and the jurisdiction of the courts of Barcelona for any dispute arising from use of the Service.

Access to an academic and scientific project

You are about to access a space dedicated to collecting personal testimonies for historical, educational, and social research purposes. The Adabida Project is part of an oral history archive with a public and scientific vocation.

Registration is voluntary. Many form fields are optional, but filling them out in detail significantly increases the documentary value of your testimony.

You can manage or delete your data at any time. The information you provide is handled with ethics, transparency, and absolute respect for the person.
